In Fremont Compensation Insurance Group v. United Technologies, 17 Trial Digest 5th 11, Mr. Lopez in his first subrogation case, tried a case against the at fault driver, while representing Fremont. The claim involved a left ankle injury and total benefits paid to the worker were $82,705. Prior to trial, and in an effort to move this toward finality, Mr. Lopez and his client made a demand for resolution at $15,000. Defendants offered $5,000 prior to trial, and $10,000 on the day of trial. As Plaintiffs were left with no choice, the matter proceeded to trail. After the trial was over, the entire workers’ compensation lien was issued or $82,705, with a 9-3 vote on liability and damages.
