Subrogation Actions
This involves incidents which are caused by the act or omission of a third party, not a worker’s co-employee. Even under these circumstances, if all requirements are met, the worker will be entitled to receive workers’ compensation benefits from his employer. However, if the injuries suffered by a worker were due to the fault of a third party, the employer and its carrier may have the right to seek reimbursement of those benefits which were paid to and on behalf of the injured worker, from the third party. Mr. Lopez will ensure any subrogation action is quickly and correctly identified and if appropriate, he will pursue reimbursement on behalf of his clients.
